Acceptance of Terms

By accessing, browsing, or using the Voci service (the “Service”) in any way, including creating an account, generating content, or viewing the website at https://voci.me (the “Website”), you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must immediately cease all use of the Service.

These Terms constitute a binding legal agreement between you and Josiah Moreton Long (“Creator,” “we,” “us,” or “our”), the sole proprietor of Voci.

Any “breach” (as mentioned in these terms and conditions) of these terms and conditions will result in the immediate termination of your account and all associated data as well as the prosedures listed in section 23 of these Terms.

Definitions

“Service” or “Voci Service” means the AI-powered letter generation platform accessible at https://voci.me and any associated services, features, or content.

“User,” “you,” or “your” means any individual or entity that accesses or uses the Service.

“Creator” or “we” means Josiah Moreton Long, the legal owner and operator of Voci.

“User Content” means any text, data, information, or other content that you input into, generate with, or transmit through the Service.

“Account” means any user account created to access the Service.

“Intellectual Property” means all copyrights, trademarks, patents, trade secrets, and other intellectual property rights in and to the Service.

User Eligibility and Account Requirements

3.1 Age Requirements

You must be at least 13 years of age to use this Service. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), if you are under the age of 18 you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms otherwise your account with Voci is void.

3.2 Account Accuracy

You agree to provide accurate, current, and complete information when creating an Account and to update such information to maintain its accuracy. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your Account.

3.3 Account Security

You must immediately notify us of any unauthorized use of your Account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Acceptable Use and Prohibitions

4.1 Lawful Use

You agree to use the Service only for lawful purposes and in accordance with these Terms and all applicable local, state, national, and international laws and regulations.

4.2 Prohibited Activities

You agree NOT to use the Service to:

• Generate content that is defamatory, harassing, threatening, hateful, or discriminatory
• Create or distribute fraudulent, misleading, or deceptive communications
• Violate any person’s privacy, publicity, or intellectual property rights
• Generate spam, unsolicited communications, or bulk messaging
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service or related systems
• Use automated systems (bots, scrapers, etc.) to access the Service without express written permission
• Reverse engineer, decompile, or disassemble any portion of the Service
• Generate content that violates any applicable law or regulation

4.2 Expected Etiquette for the sake of the elected representatives affected by Voci

By using Voci, you agree that it is your legal duty to check the content of the letters generated by the provided AI and to ensure that the letter is:

• Not defamatory, harassing, threatening, hateful, or discriminatory
• Not fraudulent, misleading, or deceptive
• Not spam, unsolicited communications, or bulk messaging
• Not impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Not interfere with or disrupt the Service or servers or networks connected to the Service
• Not attempt to gain unauthorized access to any portion of the Service or related systems
• Not use automated systems (bots, scrapers, etc.) to access the Service without express written permission

We reserve the right to delete any account or data under all circumstances. We also reserve the right to change the terms and conditions at any time and to purspone, suspend or terminate any letter or account for these reasons (and others).

User Content and Responsibility

YOU ARE SOLELY RESPONSIBLE FOR ALL USER CONTENT. Voci is merely a tool that facilitates content generation. You retain full ownership and responsibility for all content you create using the Service. We do not pre-screen, monitor, endorse, or assume responsibility for User Content.

By using the Service, you represent and warrant that:

• You have the legal right to create and distribute all User Content
• Your User Content does not violate any third-party rights
• Your User Content complies with all applicable laws
• You will not hold Voci liable for any consequences arising from your User Content
• You must and shall take full legal responsibility for all User Content you create and distribute using Voci

We reserve the right to withhold any data from any account or data under all circumstances and the right to disclose full data to any represenatives under breach of these terms.

Privacy and Data Usage

6.1 Data Collection and Use

We reserve the right to collect, store, and analyze User Content and usage data for purposes including but not limited to:

• Improving and optimizing the Service
• Ensuring compliance with these Terms
• Detecting and preventing fraud, abuse, or security threats
• Complying with legal obligations and law enforcement requests
• We reserve the right to terminate Voci at any time for no reasons whatsoever

6.2 Content Monitoring

We reserve the right, but not the obligation, to monitor, review, or access any data entered into or generated by the Service for security, legal compliance, and quality assurance purposes.

6.3 Data Retention

We reserve the right to retain User Content and Account data for as long as necessary for business, legal, or technical purposes, even after account deletion or termination.

Intellectual Property Rights

7.1 Service Ownership

All Intellectual Property rights in and to the Service, including but not limited to software, design, text, graphics, logos, and trademarks, are owned exclusively by the Creator. These Terms do not grant you any ownership rights in the Service.

7.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only.

7.3 Reproduction and Derivative Works

COMMERCIAL USE PROHIBITED: You may not reproduce, modify, distribute, or create derivative works of the Service or any portion thereof for commercial purposes without express written consent from the Creator.

Personal Use: You may use the Service for personal, non-commercial purposes in compliance with these Terms.

Public Sharing Requirements: If you share, post, or publish any modified version or derivative work based on Voci (a “Remix”), you must:

1. Clearly attribute the work to the Creator with the statement: “This project uses Voci, created by Josiah Moreton Long”
2. Include a prominent, functional hyperlink to https://voci.me
3. Provide a detailed description (minimum 150 words) explaining how you used Voci and how others can use it
4. Title your work “Voci Remix” or “[Your Name]’s Voci Remix”
5. Include these Terms and Conditions with your Remix
6. Make clear that your Remix is not officially endorsed by or affiliated with the original Voci service

Failure to comply with these attribution requirements constitutes copyright infringement and breach of these Terms. Voci also reserves the right to terminate any “Remix” or afilliated sites that do not comply with these terms and conditions.

Disclaimers and Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties regarding accuracy, reliability, or completeness of content
• Warranties that the Service will be uninterrupted, timely, secure, or error-free
• Warranties that defects will be corrected
• Warranties regarding third-party content or services

No advice or information obtained from us or through the Service creates any warranty not expressly stated in these Terms.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VOCI, THE CREATOR, OR ANY AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Business interruption
• Reputational harm
• Legal costs or expenses
• Damages resulting from User Content
• Any other damages, whether based on contract, tort, strict liability, or otherwise

This limitation applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

AGGREGATE LIABILITY CAP: In no event shall our total aggregate liability exceed the amount you paid to use the Service in the 12 months preceding the claim, or $100 USD, whichever is less.

Indemnification

You agree to indemnify, defend, and hold harmless Voci, the Creator, and our affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from:

• Your use or misuse of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

Termination and Suspension

11.1 Our Right to Terminate

We reserve the right, in our sole discretion, to:

• Suspend or terminate your Account at any time for any reason or no reason
• Delete any User Content at any time without notice
• Refuse service to anyone for any reason
• Discontinue the Service entirely at any time

11.2 Effect of Termination

Upon termination of your Account, your right to use the Service immediately ceases. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11.3 No Refunds

Termination of your Account does not entitle you to any refund of fees paid, if applicable.

Modifications to Terms

We reserve the right to modify, amend, or update these Terms at any time, in our sole discretion. We will notify you of material changes by:

• Posting the updated Terms on the Website with a new “Effective Date”
• Sending notice to the email address associated with your Account (if applicable)
• Displaying a notice on the Service

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service immediately.

It is your responsibility to review these Terms periodically. We recommend checking this page regularly for updates.

Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

The Service may contain links to third-party websites, services, or resources. We do not endorse and are not responsible for any third-party content, products, or services. Your interactions with third parties are solely between you and that third party. You access third-party services at your own risk.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States of America and, where applicable, the laws of the state in which the Creator resides, without regard to conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in the Creator’s jurisdiction, and you irrevocably consent to the personal jurisdiction and venue of such courts.

Dispute Resolution

16.1 Informal Resolution

Before filing any formal claim, you agree to first contact us at hello@voci.me to attempt to resolve the dispute informally.

16.2 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms constitute the entire agreement between you and Voci regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, pandemics, government actions, or internet/telecommunications failures.

Breach of Terms and Conditions

Any breach of these terms and conditions will result in a certain amount of the immediate following procedures:

• The immediate termination of your account and all associated data
• The immediate deletion of any User Content you have created
• The immediate suspension of your account
• The immediate deletion of any User Content you have created

Claims and Data Disclaimer

The Tool and it’s creator reserve the right to make any claims without specific numerical data or otherwise. Therefore, by your agreement to these Terms, The Tool or it’s creator can not be held responsible for any of these claims, implied or otherwise.
